If you have been involved in a car accident you need to contact an attorney immediately.  While some individuals may be able to walk away from a car accident without injury, many others suffer the physical, mental or emotion scars from the event.  Spinal injuries, whiplash, back injuries, and muscle tears are only some of the common injuries we witness in our clients.  Some of our clients may not realize that they are injured until a few days after an accident.  Others do not immediately realize the extent of their injuries only to later discover that the severity of their injuries are much more extreme than originally believed.

What Do I Do Following A Car Accident?

Immediately following a car accident the police should be called, medical attention sought and any witnesses to the accident identified.  Your insurance company should also be notified of the accident but you should not sign any document or give any recorded statement, without the presence of an attorney. While most insurance policies will require you to obey your insurance company’s request for information, your attorney may be present.  An attorney will also review any document you are asked to sign to determine its contents and make sure you are not waiving any rights you have.  As such, the retention of an attorney as soon as possible is key.

Photographs of the scene, injuries and damage to the vehicles should also be taken.  If these photographs were unable to be taken on the date of the accident, they can be taken after the accident, however sooner is always better than later.  If you cannot personally take these photographs, ask a loved one to help you.  These will be helpful to your attorney working on your case.

If your car needs to be towed from the scene, or if it has already been towed, instruct the company which removed your vehicle not to destroy the vehicle.  Ask them to store it.

You may receive a check in the mail from the insurance company.  Consult with an attorney before you sign and deposit this check.  Often these checks are grossly inadequate to the damages one has a result of a car accident and the signing and depositing of the check may waive your right to pursue action later.

Many people are unaware that they have a case or of the laws designed to protect them.  Instead, individuals accept low settlements, or even forego compensation altogether, after speaking to skilled negotiators specifically hired by insurance companies to settle your claim for as little, and as quickly, as possible.  This could cost the individual a substantial amount in potential damages which could have been recovered by a qualified and committed attorney who is there to fight for your rights.

Therefore, it is important for injured people to secure counsel so that communication, if any, is conducted in the presence of the attorney and only after full and proper consultation.  Regardless of what you are told by an adjuster or insurance representative, do not give a statement to any adjuster until you have consulted with and secured an attorney.
Once representation begins, you will want an attorney who will examine your case from every angle and allow you the opportunity to do what is most important, focusing of getting well.  If resolution cannot be reached, you will want an attorney who will handle your lawsuit from filing to trial and who will advise you of the strengths and weaknesses in your case along the way.
